Under the Immigration & Nationality Act, there are certain circumstances that make an individual inadmissible or ineligible for certain forms of relief. In a few cases, one can apply for a waiver of inadmissibility.

Some common waivers are:

  • The I-601A Provisional Waiver which allows an applicant to apply stateside to waive one unlawful entry or one instance of unlawful presence
  • The regular I-601 can be used at an Embassy or during consular processing to waive issues of health related exclusions, misrepresentations or fraud, among many others
  • The I-212 is used to waive inadmissibility due to a former deportation
